SAMPLE INSTRUCTION:
If you find that the state has proven beyond a reasonable doubt that __________ (name of juvenile) technically committed a delinquent act, but you also conclude that the facts show that __________’s (name of juvenile) conduct was not within the heart and purpose of the law as the judge has explained it to you, you may find that __________ (name of juvenile) was not delinquent. A finding of delinquency requires that you find that __________ (name of juvenile) was ______ (minimum age e.g., 12) years of age or older, but less than _______ (maximum age e.g., 18) years of age, on __________ (date), and that __________ (name of juvenile) violated a state law, that is, __________ (name of juvenile) __________ (violation e.g., operated or handled a dangerous weapon, in a manner constituting criminal negligence, and that his criminal negligence endangered the safety of another person).
