257.3.8.2 Entrapment: Failure To Instruct As Reversible Error Per Se
PRACTICE NOTE: It is reversible error to refuse to instruct jury that when defense of entrapment is raised. (State v. Bean (AZ 1978) 581 P2d 257, 259; see also Sebastian v. Commonwealth (KY 1979) 585 SW2d 440 ; State v. Bisson (ME 1985) 491 A2d 544, 546; U.S. v. Timberlake (5th Cir. 1977) 559 F2d 1375, 1379-80; Hollis v. Gomez (CIV-90-0904 GEB) [refusal to instruct upon entrapment was reversible error per se].)
