257.3.3.2 Entrapment: Prosecution Burden -- Unitary Versus Bifurcated Approach
PRACTICE NOTE: The unitary approach requires the defendant to present prima facie evidence of both inducement and nonpredisposition in order to obtain an entrapment instruction. (See e.g., U.S. v. El-Gawli (3d Cir. 1988) 837 F2d 142, 145-47.) Under the bifurcated approach of some circuits, the defendant only needs to present prima facie evidence of inducement at which point the burden shifts to the prosecution to either rebut that evidence or prove beyond a reasonable doubt that there was predisposition. (See generally LaFave & Scott, Substantive Criminal Law (West, 1986) § 5.2f(4), p.610.)
