PRACTICE NOTE: Consent is a complete defense to a charge of false imprisonment. (See e.g., People v. Haney (CA 1977) 75 CA3d 308, 313 [142 CR 186]; see also Hanna v. Marshall Field & Co. (IL 1996) 665 NE2d 343, 349 [voluntary consent to confinement nullifies tort of false imprisonment]; State v. Niska (MN 1994) 514 NW2d 260, 266 [consent of child's mother, who was physical and legal custodian, was sufficient to relieve grandparents of any liability for false imprisonment for confining or restraining child, despite fact that they did not seek consent of other, noncustodial parent].)
