    103.7.1.3    Mail Fraud (18 USC 1341): Venue   

PRACTICE NOTE:  U.S. v. Mikell (E.D.Mich. 2001) 163 FSupp2d 720, 729 held that the nature of a mail fraud offense is the misuse of mail facilities, not the fraudulent activity.  Therefore, venue is only appropriate in a district where the misuse occurred.
