103.5.2.2 Applicability Of Embezzlement To Real Property
PRACTICE NOTE: The few cases in the United States to have dealt with the specific question of whether real property is covered by the embezzlement crime are not in accord. (See e.g., U.S. v. Kehoe (DC 1973) 365 FSupp 920, 924; People v. Roland (CA 1933) 26 P2d 517, 519, 134 CA 675, 679 [real property subject to embezzlement]; Manning v. State (GA 1932) 166 SE 658, 659-60; State v. Clark (OH 1938) 21 NE2d 484, 486-88 [real property not subject to embezzlement]; Wharton’s Criminal Law (West, 15th ed. 1993) § 8.6, pp. 371 (1972) [conviction for embezzlement of real property should be possible].)
