    103.10.2.1    Extortion By Public Officer: Requirement That The Person Actually Hold Public Office -- False Pretense Insufficient

PRACTICE NOTE: Extortion by a public officer is not committed if the defendant lies to another regarding the defendant's position as a public officer. (See Drake v. State (OK 1909) 103 P 878, 879; U.S. v. Tomblin (5th Cir. 1995) 46 F3d 1369, 1386 [private person cannot be convicted of extortion under color of official right under Hobbs Act].)

    Nor is extortion by a public officer committed if the defendant is merely an employee of the state rather than a public officer. (See OKLAHOMA UNIFORM JURY INSTRUCTIONS - CRIMINAL, OUJI-CR 5-34, comments [Extortion Misdemeanor-Elements] (Oklahoma Center for Criminal Justice, 2nd ed. 1996).)

PRACTICE NOTE: In People v. Serrano (CA 1992) 11 CA4th 1672, 1677-78 [15 CR2d 305], the court held that the claim of right defense which applies to a charge of theft does not apply to the crimes of extortion or kidnap for ransom.
