83.4.3.4    Conspiracy: Defense Theory That Statements As To The Existence Of Conspiracy ("Spilling The Beans") Do Not Further The Conspiracy

PRACTICE NOTE: A statement that merely discloses the existence of a conspiracy to a conspirator -- that merely "spills the beans" with no intention of recruiting the other person into the conspiracy -- does not further the conspiracy. (Tuscaloosa v. Harcros Chemicals, Inc. (11th Cir. 1998) 158 F3d 548, 559.)
