    77.8.3.2    Defense Theory That Shooting Within A Building Does Not Violate A Statute Proscribing Shooting At Inhabited Dwelling

PRACTICE NOTE: Firing a firearm within a dwelling does not violate the California statute proscribing shooting at a building (Penal Code § 246) unless the weapon was fired from one dwelling unit into an adjoining one through a common wall or floor or ceiling. (People v. Jischke (CA 1996) 51 CA4th 552 [59 CR2d 269]; see also People v. Stepney (CA 1981) 120 CA3d 1016, 1018 [175 CR 102]; English v. State (GA 1912) 74 SE 286; Gaines v. Commonwealth (KY 1974) 505 SW2d 174; People v. Roach UNPUBLISHED (A069056) [California Penal Code § 246 conviction reversed where defendant's hand and firearm were inside house when he fired].)
