Wire Fraud Depriving Another Of Intangible Right Of Honest Services (18 USC 1343 And 18 USC 1346)

PRACTICE NOTE: Deprivation Of Honest Services. See U.S. v. Bloom, 149 F3d 649 (7th Cir. 1998) [reversal of honest services fraud conviction of a Chicago alderman who in his private capacity as a lawyer advised a client to use a proxy bidder at a tax scavenger sale at which the client's property was being auctioned, thereby depriving the city of tax revenues; alleged scheme to defraud in Bloom did not involve anything that the defendant did in his official capacity]; but see U.S. v. Panarella,  277 F3d 678, 680 (3d Cir. 2002) [if public official fails to disclose a financial interest in violation of state criminal law and takes discretionary action that the official knows will directly benefit that interest, then that public official has committed honest services fraud under 18 USC 1346].
