Jeopardy attaches in a criminal jury trial when the jury is impaneled and sworn.
United States v. McKoy, 78 F.3d 446, 449 (9th Cir.), cert. denied, 519 U.S. 817 (1996); Willhauck v. Flanagan, 448 U.S. 1323 (1980). "Jeopardy terminates when the jury reaches a verdict, or when the trial judge enters a final judgment of acquittal." United States v. Byrne, 203 F.3d 671, 673 (9th Cir. 2000), cert. denied, 531 U.S. 1114 (2001) (citing Fong Foo v. United States, 369 U.S. 141, 143 (1962)).A MANUAL OF JURY TRIAL PROCEDURES - 2004
